AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement between you, the customer, and Quarter Athletic, governing your access to and use of our products, services, website, and all divisions and sub-brands operating under the Quarter Athletic name. By placing an order, using our website, or engaging with any Quarter Athletic division, you agree to be bound by these Terms in their entirety. If you do not agree, you must discontinue use immediately.
These Terms apply to all apparel lines, collections, custom orders, collaborative programs, and any other goods or services offered under the Quarter Athletic brand, including but not limited to team apparel, custom uniform programs, retail collections, and any affiliated divisions.
1. SIZE CHARTS AND FIT ACCURACY
Quarter Athletic provides size charts as general reference guides to assist customers in selecting appropriate sizing. These charts are based on standard garment measurements and are updated periodically to reflect our product offerings.
1.1 Customer Responsibility. It is the sole responsibility of the customer to review and accurately interpret all provided size charts prior to placing an order. Quarter Athletic makes reasonable efforts to ensure the accuracy of size chart information; however, individual body measurements, personal fit preferences, fabric composition, and garment construction can result in variation between expected and actual fit.
1.2 Limitation of Liability. Quarter Athletic shall not be held liable for any dissatisfaction, loss, or damages arising from the misreading, misinterpretation, or misapplication of our size charts by the customer. This includes, but is not limited to, ordering an incorrect size, selecting the wrong fit type, or failing to compare personal measurements to provided garment dimensions.
1.3 Discretionary Returns and Refunds on Size Issues. Returns and refunds related to sizing are evaluated on a case-by-case basis at the sole discretion of Quarter Athletic. Quarter Athletic reserves the right to deny a return or refund request if, upon review of all available information — including the original size chart, the customer's stated measurements, and the order details — it is determined that the customer had sufficient information to make an informed sizing decision. Quarter Athletic's determination in these matters is final.
1.4 Custom and Team Orders. For custom, team, or bulk orders where sizing is submitted by the customer or a team representative, Quarter Athletic bears no responsibility for incorrect sizes submitted. No refunds or exchanges will be issued for custom orders on the basis of sizing errors made at the time of order submission.
2. RETURNS, REFUNDS, AND EXCHANGES
2.1 General Policy. Quarter Athletic reviews all return and refund requests individually. We reserve the right to approve or deny any return or refund request at our sole discretion based on the circumstances of the order, the condition of the product, the time elapsed since delivery, and all other relevant information provided.
2.2 Eligibility. To be considered for a return or exchange, items must be unused, unwashed, unaltered, and in original condition with all tags intact. Quarter Athletic is not obligated to accept returns that do not meet these criteria.
2.3 Non-Returnable Items. The following items are non-returnable and non-refundable under any circumstances unless a manufacturing defect is confirmed by Quarter Athletic:
- Custom or personalized apparel
- Team uniforms and bulk orders
- Clearance or final sale items
- Items marked as non-returnable at the time of purchase
2.4 Defective or Damaged Items. If you receive an item that is defective or damaged due to a manufacturing error, you must notify Quarter Athletic within seven (7) days of delivery with supporting documentation, including photographs. Quarter Athletic will review the claim and determine the appropriate remedy, which may include replacement, store credit, or refund at our discretion.
2.5 Restocking Fee. Quarter Athletic reserves the right to apply a restocking fee to any approved return. The applicable restocking fee will be communicated to the customer at the time the return is authorized.
2.6 Shipping Costs. Return shipping costs are cover by Quarter Athletic.
3. INTELLECTUAL PROPERTY
3.1 Quarter Athletic Brand Ownership. All original apparel designs, graphics, logos, trade dress, patterns, cuts, colorways, and visual elements created and produced by Quarter Athletic are the exclusive property of Quarter Athletic. These works are protected under applicable international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws, including but not limited to the laws of the United States and applicable international treaties and conventions. Unauthorized reproduction, distribution, imitation, or use of any Quarter Athletic proprietary design — in whole or in part — is strictly prohibited and may result in civil and criminal liability.
3.2 Collegiate and Club Logos. Certain apparel produced by Quarter Athletic may bear logos, marks, insignia, mascots, word marks, or other identifiers belonging to collegiate institutions, athletic conferences, club organizations, or other third-party entities. These Third-Party Marks are not the property of Quarter Athletic. All rights to such marks remain with their respective owners. Quarter Athletic's production of apparel featuring Third-Party Marks is conducted under applicable licensing arrangements or at the direction of the ordering entity. Quarter Athletic makes no claim of ownership over any collegiate, club, or institutional intellectual property.
3.3 No License Granted. Nothing in these Terms or in the purchase of Quarter Athletic products grants the customer any right, title, interest, or license in or to any Quarter Athletic intellectual property beyond the right to use the purchased product for its intended personal purpose.
3.4 Customer-Submitted Artwork. If a customer submits artwork, logos, or design files for use in production, the customer represents and warrants that they have full legal right and authority to use and authorize the reproduction of such materials. Quarter Athletic assumes no liability for any third-party intellectual property claims arising from customer-submitted artwork.
4. ORDERS AND PAYMENTS
4.1 Order Acceptance. Submission of an order does not constitute a binding contract until Quarter Athletic confirms acceptance. Quarter Athletic reserves the right to cancel or refuse any order at any time for any reason, including but not limited to product availability, errors in pricing, or suspected fraudulent activity.
4.2 Pricing. All prices are subject to change without notice. Applicable taxes, shipping fees, and any custom or rush production charges will be disclosed prior to order confirmation.
4.3 Payment. Full payment or an approved deposit is required prior to production on all custom and team orders. Quarter Athletic accepts the payment methods listed on our website or order portal at the time of purchase.
4.4 Production Timelines. Estimated production and delivery timelines are provided as a courtesy and are not guaranteed. Quarter Athletic is not liable for delays caused by material shortages, shipping carrier issues, natural events, or other circumstances outside of our reasonable control.
5. PRODUCT ACCURACY AND DESCRIPTIONS
Quarter Athletic makes reasonable efforts to accurately represent product colors, materials, and details in all photography and written descriptions. Due to variations in display screens, monitor calibration, and lighting conditions in photography, actual product colors may differ slightly from those shown. These variations do not constitute grounds for a return or refund.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Quarter Athletic, its owners, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your purchase or use of Quarter Athletic products, even if Quarter Athletic has been advised of the possibility of such damages. In all cases, Quarter Athletic's maximum liability to any customer shall not exceed the amount paid by the customer for the specific product giving rise to the claim.
7. DISCLAIMER OF WARRANTIES
Quarter Athletic products are provided "as is." Except as expressly stated in these Terms, Quarter Athletic makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow the exclusion of implied warranties; in such cases, limitations apply to the fullest extent permitted by law.
8. PROHIBITED USES
You agree not to use any Quarter Athletic product, platform, or service to:
- Reproduce or imitate Quarter Athletic designs or trademarks without authorization
- Engage in fraudulent chargebacks or misrepresentation of orders
- Submit third-party intellectual property without authorization for use in custom production
- Harass, threaten, or harm Quarter Athletic employees, representatives, or affiliates
- Violate any applicable local, state, national, or international law or regulation
9. PRIVACY
Quarter Athletic collects and processes customer information in accordance with our Privacy Policy, which is incorporated herein by reference. By placing an order or engaging with any Quarter Athletic service, you consent to the collection and use of your information as described in the Privacy Policy.
10. MODIFICATIONS TO TERMS
Quarter Athletic reserves the right to update, modify, or replace these Terms at any time. Changes will be effective upon posting to our website or direct notification to customers. Your continued use of our products or services following any modification constitutes your acceptance of the revised Terms.
11. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or any Quarter Athletic product or service shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina. Both parties consent to personal jurisdiction in such courts and waive any objection to venue.
12. SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
13. ENTIRE AGREEMENT
These Terms, together with any applicable order confirmation, custom production agreement, and Quarter Athletic's Privacy Policy, constitute the entire agreement between you and Quarter Athletic with respect to the subject matter herein and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
